The Employment Relations Authority has fined a company
$15,000 after it failed to pay wages awarded of $4,383 in a previous Employment
Relations Authority hearing. A maximum
fine for this breach would have been $20,000 and the failure to pay was
regarded as serious and intentional.
The company had also failed to pay the damages awarded
previously for hurt and humiliation of $5,000.
The ERA has no authority to order a penalty in this regard but the
employee can apply to the Employment Court for a fine of up to $40,000 and for
imprisonment of the directors of the employing company. Watch this space.
