An employer agreed at mediation to pay
the legal costs of their employee by a certain date. They did not do so and
instead used the money to pay other bills. Eventually paying the costs by
instalments after the employee applied for an enforcement order. The Employment
Relations Authority has awarded further costs of $596 against the employer for
failing to pay the original costs as agreed. It held that the employer was obliged
to pay on time and had no right to prioritise other bills over the costs
payment.
