The
Employment Relations Authority had rejected the claim for unjustified
dismissal. The Employment Court
overturned that decision after a delay of 26 months between the hearing and
decision.
The
employer sought to appeal partly on the basis that the long delay in the
judgment meant that the Court could not do justice between the parties.
The Court
of Appeal commented on the position of several cases with delays, ranging from
19 to 33 months, between the hearing and decisions, and said while the delay
was wholly unsatisfactory it did not mean that justice was not done.
