The Employment Relations Authority has upheld
a claim for unpaid wages and holiday pay and ordered an employer to pay wages
and holiday pay owed to the former employee. The Authority also ordered that if
the company was unable to pay the money, the director was personally liable to
pay.
The employee had been employed for 9
months before they resigned to pursue another role. The employer failed to pay
the employee their final week of wages and holiday pay. The Authority decided
the director of the company was a person involved in the debt as they were the
sole director and shareholder of the company, accepted timesheets and organised
the wage payments.
