employee’s claim that issues with her performance resulted in her redundancy…
An employee
who worked as a sales manager and was made redundant has had her personal
grievance claim for unjustified dismissal rejected by the Employment Relations
Authority.
The ERA
held that the employer was justified in making the employee’s position
redundant as the business was suffering from financial difficulties and cuts
needed to be made in order to reduce costs.
The ERA
found that there were no ulterior motives in the employer’s decision to dismiss
the employee. The ERA noted that the employer valued the employee and had no
issues with the employee’s performance or hours of work.
The ERA
stated that the employer followed a fair procedure when terminating the
employee’s position as she was provided with the necessary information
regarding her employment and had the opportunity to respond to the employer’s
concerns about the continuation of her employment.
