The Employment Relations Authority has upheld a personal
grievance claim by an employee after he resigned when his wages were not
paid. The ERA held that the non-payment
of wages forced the employee to resign and that this was therefore a
constructive dismissal.
As well as ordering the payment of the unpaid pay (plus
costs), the ERA also awarded $12,000 compensation for the unjustified
dismissal.
