In a recent Employment Relations Authority decision an employee who claimed to have lost trust and confidence in her employer found herself dismissed by her employer on that basis.
The Authority held that as the employee had lost trust and confidence in her employer, the employer was justified to terminate the employment relationship. The employee’s tactic of trying to put the blame on the employer backfired badly.
If that wasn’t enough, the Authority went on to say that the employer would have been entitled to dismiss for the employee’s bad behavior (swearing and banging doors and causing anxiety to the children in her care). The employee was held to be 100% responsible for the situation.
